Terms of Sale
By placing an order with American Timber and Steel, you agree to be bound by the following terms and conditions. Please read these terms carefully before completing your purchase. If you do not agree to these terms, you may not proceed with the order.
Terms of Payment
We accept credit or debit cards for orders under $10,000, including Visa, Mastercard, American Express and Discover. For orders above $10,000 payment can be made via Wire Transfer, ACH or Certified Check. Personal and Company checks are only accepted upon approval by the Credit Department. Contact your sales representative to obtain banking information for electronic payments.
Credit Accounts*
One of our friendly and knowledgeable sales associates will be assigned to your account. Once your credit application has been completed and approved you will be able to purchase items on account and have the flexibility to pay within our stated credit terms. *Additional terms and conditions are required, and all accounts are subject to credit approval.
Pricing
All shipments will be processed at prices prevailing at the time of order confirmation. Price quotes are valid for 7 days, unless otherwise noted.
Product Information
Product specifications, dimensions, capacities, weights, etc. are kept as up to date as possible, but are also subject to change without notice. There may be slight dimensional variations due to the nature of wood and many of our components being hand made. For specific product information or measurements, please contact an American Timber and Steel representative. American Timber and Steel makes no warranty concerning the merchantability of the products or their suitability or fitness for any particular purpose or use.
Shipping
All orders are shipped as close to the scheduled shipping date as possible. All orders are F.O.B. our warehouses. Shipments may be subject to additional charges such as residential delivery, lift gate service, COD fees, oversize shipment, re-consignment, metro delivery, and other fees.
Claims & Returns
Please inspect the shipment immediately.
- Upon receipt of order, damages, overages, and shortages must be reported within 5 business days of receipt by notifying American Timber and Steel at 800-551-9663.
- Retain the merchandise AND packing material for inspection by the carriers.
- In order to receive replacement product or to file a claim, shortages and/or damages must be noted on the bill of lading at the time of delivery by the individual receiving the shipment. Any damage or loss incurred in transit is the responsibility of the carrier.
- All claims must be made before installation, use or alteration of the product. Cutting, drilling, planing, painting, staining, or altering the product in any way, without written authorization by American Timber and Steel, voids all claims.
Returned Goods
Prior to returning material for any reason, you must contact our Customer Service Department at 800-551-9663. An RMA number (Return Material Authorization number) is required for all returns. Returns unaccompanied by an RMA cannot be accepted. For prompt credit processing, please put the RMA number on the packaging. Stock items ordered in error may be returned freight prepaid for credit within 30 days subject to a 20% restocking fee or $10 minimum. We will be pleased to issue an in-store credit upon American Timber and Steel’s inspection and approval. Special ordered items cannot be returned. Returns over 30 days from invoice date will not be accepted. Please have your invoice on hand when calling. Any product cut, drilled, painted, or altered in any way by the customer is nonreturnable. Any loss incurred for labor, time and shipping is not covered. American Timber and Steel has no control over end products fabricated with the products purchased from American Timber and Steel or the installation procedures used. No warranty is expressed or implied. All material must be inspected for quality before installation. If further details are required, please contact us.
Back Orders
Items that are out of stock will be automatically back ordered and shipped as soon as they are available, F.O.B. our warehouses. Any unwanted back orders should be cancelled immediately.
Technical Advice
American Timber and Steel makes no warranty of results obtained as a result of technical advice furnished by American Timber and Steel. The customer shall test and verify suitability for intended use. All drawings and dimensions shown in the catalog are for reference only.
Warranty & Liability
All merchandise is produced to standard and commercial tolerances. American Timber and Steel warranties its products to be free from defects in workmanship and material. No other warranty is expressed or implied. In particular, American Timber and Steel makes no warranty concerning the merchantability of the products or their suitability or fitness for any particular purpose or use. The customer is responsible for testing and verifying the suitability of the product for its intended use. American Timber and Steel’s liability is limited at our election to (1) issue of in-store credit of Buyers purchase price, (2) replacement of such products, or (3) repair of such products. American Timber and Steel is not liable for any loss, damage, or compensation from the use of the product.
Safety Notice
American Timber and Steel emphasizes the importance of safety when handling wood products. Woodworking materials, by their nature, can pose certain hazards if mishandled or used improperly. Users must exercise caution, adhere to safety guidelines, and utilize appropriate personal protective equipment when working with our products. This includes, but is not limited to, wearing eye protection, gloves, and respiratory protection as deemed necessary. Users should also familiarize themselves with the Safety Data Sheets (SDS) provided for specific products, understanding their properties and potential risks.

American Timber and Steel asserts that while our products are manufactured to high standards, they are used at the customer's own risk. We cannot guarantee outcomes or be held responsible for accidents, injuries, or damages resulting from the use, misuse, or handling of our materials, whether used alone or in combination with other products. Customers are encouraged to carefully inspect all materials upon receipt and before use to ensure suitability for their intended application.
User Submissions
Any submissions, feedback, suggestions, or ideas voluntarily provided to American Timber and Steel become the property of the company. By submitting such materials, you grant us the irrevocable right to use, modify, reproduce, distribute, and display them without any obligation for compensation or acknowledgment. These submissions may be utilized for product improvement, marketing, or any other purposes deemed appropriate by American Timber and Steel.

Indemnification
By placing an order with American Timber and Steel, you agree to indemnify and hold us harmless from any claims or damages in connection with the placed order or any other dispute between the Parties or related to the product or transportation of the product. We strive to provide accurate and reliable information, but we cannot guarantee absolute error-free content. The act of placing an order is an acceptance of this indemnification clause.
Direct Negotiation
Any claim, dispute, or other matter in question arising out of or related to the relationship between the American Timber and Steel and the Customer shall be subject to a written request to seek to resolve such through direct negotiation at a meeting of the senior management of American Timber and Steel and the Customer as a condition precedent to mediation. The Parties shall endeavor to schedule a meeting within two weeks of such request.
Mediation
Any claim, dispute, or other matter in question arising out of or related to the relationship between the American Timber and Steel and the Customer shall be referred to mediation upon written request of either party. The Parties shall agree to a qualified mediator to assist in reaching a resolution of the Parties’ differences. No litigation or other judicial processes may be commenced until a mediation hearing has been conducted between the parties. Each party will be responsible for its own costs including attorneys’ fees. The parties will equally share the cost of the Mediator.
Governing Law and Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio.
Each party hereby consents to the exclusive jurisdiction and venue of the state courts located in Erie County, Ohio for any legal action or proceeding arising out of or related to this Agreement.
Continuing Effect of Terms of Service
These terms and conditions are effective and apply not only to the current order but also to all future orders, correspondence, contracts, and any other interactions with American Timber and Steel, unless expressly modified or superseded by written agreement. By engaging in any transaction or interaction with American Timber and Steel, you acknowledge and agree that the most recent version of these terms and conditions available on our website or provided to you shall govern such transactions or interactions.
